Terms of Service
These terms are the agreement between you and Rackvolt Cloud Solutions Pvt Ltd, the company that operates RyzenRDP. They are written to be read: if anything is unclear, ask us before you order.
Agreement
These Terms of Service ("Terms") are a contract between you and Rackvolt Cloud Solutions Pvt Ltd, a private limited company incorporated in India ("we", "us"), which provides the RyzenRDP service. By creating an account, placing an order or using a service, you accept these Terms and the policies that form part of them: the Acceptable Use Policy, the Refund and Cancellation Policy and the Privacy Policy. If you do not agree, do not order or use the service.
- You must be at least 18 years old and able to enter a binding contract where you live. If you order for a business, you confirm that you may act for it, and "you" includes that business.
- The details you give us must be accurate, complete and kept up to date. We may ask you to verify your identity, your contact details or the purpose of a service, before or after setup, including where Indian law requires server providers to keep verified customer records. We may decline or suspend a service that cannot be verified.
- These Terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.
The service
- Each plan is a Windows Server virtual private server (VPS) with the vCPU, memory and storage shown when you order, in the location you choose. Current plans and prices are on the pricing page.
- vCPUs are shared. Your server's virtual processors run on a physical host that other servers also use; they are not reserved physical cores. Heavy, sustained use is balanced with the other servers on the host under the fair-use rules of the Acceptable Use Policy.
- Network. Each server has a 1 Gbps network port and one dedicated IPv4 address. Bandwidth is unmetered (fair share): there is no monthly transfer cap, and the network is shared fairly, so traffic that harms the network or other customers may be limited.
- You get full Administrator access. We look after the hardware, the network and the virtualisation layer; you look after everything inside your server, including Windows updates, security settings, software and data.
- Support is available 24 hours a day, 7 days a week through tickets in the console and by email. It covers the service we provide (access, the network, the hardware and the Windows installation we deliver). We help with your own software where we can, but that is not part of the service.
- We do not promise that the service will be uninterrupted or free of errors, and we do not publish an uptime percentage. Where planned maintenance affects your server, we try to tell you in advance.
Ordering and setup
- You order through the configurator or the console. An order is accepted once its invoice is paid and the payment is confirmed.
- We set up your server within 24 hours of confirmed payment, and its sign-in details appear in the console. Setup is not instant.
- We may decline an order, or cancel it before setup, for example when a location has no capacity, the details cannot be verified, or the order appears fraudulent or would breach these Terms. If we cancel an order you have paid for, we refund it as described in the Refund and Cancellation Policy.
- There is no free trial.
Billing and renewals
- Prices are in US dollars. Services are prepaid for the billing cycle you choose: 1, 3, 6 or 12 months, at the same monthly price.
- Payment is made in cryptocurrency through Cryptomus. You pay each invoice from the console on the Cryptomus payment page. Cryptomus sets the amount of cryptocurrency from the invoice amount in US dollars when you pay; the blockchain network fee for sending it is yours.
- Send the exact amount shown. If less arrives, the invoice stays unpaid until the balance is paid, and we contact you. If more arrives, we add the difference to your account credit.
- We do not store cards or wallets and never charge you automatically. Before each renewal we issue an invoice, by email and in the console.
- Prepaid account credit is applied automatically to new invoices, including renewals.
- Any tax that applies to your order is shown on the invoice before you pay.
- If a renewal invoice is not paid by its due date, we may suspend the service and, if it stays unpaid, terminate it. Data on a terminated server is deleted and cannot be recovered.
- We may change prices for future billing periods. A new price applies from your first renewal after we have told you about it, and never to a period you have already paid for.
Acceptable use (summary)
You may not use the service for anything illegal or abusive, including spam and bulk email; hacking, scanning, brute-forcing and attacks on other networks, including denial-of-service attacks; fraud, phishing and malware; illegal content or content that infringes others' rights; unlicensed or pirated software; and cryptocurrency mining. The Acceptable Use Policy is part of these Terms and sets out the full rules.
Your account and security
- Keep your console password and your server's Administrator password safe, and turn on two-factor authentication for your console account. You are responsible for everything done with your account and on your servers.
- Tell us at once if you think your account or a server has been compromised.
- We never ask for your password. We sign in to your server only when you ask us to, or when the law or an abuse or security investigation requires it.
Your data and backups
- You keep all rights in the data and software on your server.
- Backups are your responsibility. Plans do not include a backup service, so keep copies of anything you need somewhere else.
- When a service ends, its virtual disk is deleted and cannot be recovered. Copy your data before you cancel, or before an unpaid renewal falls due.
Software and licences
- Windows Server is provided with the plan, with no separate licence fee. You may use it only on the server it was installed on.
- Software you install yourself must be properly licensed by you. That includes Remote Desktop Services client access licences (RDS CALs) if more than two people need to use the server at the same time: Windows Server allows two administrative Remote Desktop sessions without them.
Suspension and termination
- You may cancel a service at any time from the console. It keeps running until the end of the period you paid for and is not renewed.
- We may suspend or terminate a service immediately, without notice, if it breaches these Terms or the Acceptable Use Policy, puts our network, other customers or anyone else at risk, is the subject of a valid legal order or request from an authority, or if your account details prove to be false. Where the problem is accidental, such as a compromised server, we normally contact you first and give you the chance to fix it.
- We may also end a service for any other reason with 30 days' notice. We then refund the unused part of the period you paid for.

Refunds
There is no free trial and no money-back guarantee. A refund is possible only in the cases set out in the Refund and Cancellation Policy, and account credit is not refundable.
Liability
- The service is provided "as is" and "as available". To the extent the law allows, we give no warranties beyond those stated in these Terms.
- To the extent the law allows, we are not liable for indirect or consequential loss; loss of profit, revenue, business or data; or loss caused by events outside our reasonable control, including failures of third-party networks, power, data centres or software.
- Our total liability for all claims about a service is limited to the amount you paid us for that service in the three months before the event that gave rise to the claim.
- Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the law that applies to you.
Indemnity
You will compensate us for claims, losses and reasonable costs, including legal fees, that arise from your use of the service in breach of these Terms or the law, including claims by others about content or activity on your server.
Changes to these Terms
We may update these Terms, for example when the law or the service changes. The "Last updated" date at the top shows the current version. If a change materially affects you, we tell you by email or in the console before it takes effect; using the service after that date means you accept the change.
Governing law
These Terms are governed by the laws of India. Subject to any mandatory rights you have as a consumer where you live, the courts of India have jurisdiction over any dispute arising from them. Before going to court, please contact us so that we can try to resolve the matter.
Grievances
Complaints about the service, about content on our network, or about how we handle your personal data can be sent to our Grievance Officer at [email protected] with "Grievance" in the subject. We acknowledge a complaint within 24 hours and aim to resolve it within 15 days.

General
- If a court finds part of these Terms unenforceable, the rest stays in force.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your account or services to someone else without our written agreement. We may transfer our rights and obligations to a company that takes over the RyzenRDP service, and we will tell you if we do.
- These Terms, with the policies they refer to, are the whole agreement between you and us about the service.
